Frequently Asked Questions About Family Reunification

Are you unsure about the rules or your options for family reunification?

Here you will find answers to the most common questions.

What is the difference between family reunification under Danish law and EU rules?

Under Danish law, fixed requirements apply, including requirements concerning housing, finances and attachment. Under EU rules, the case is instead assessed on the basis of residence rights and genuine residence in another EU-country. The right solution depends on your specific situation.

When may the EU rules be relevant?

The EU rules may be relevant if you, as a Danish citizen, have had genuine residence in another EU country and meet the conditions for a right of residence. This requires a specific legal assessment.

How do I extend my residence permit based on family reunification?

A residence permit must be extended before it expires, and this requires that the conditions continue to be met. We assist with submitting the application in due time and with the correct documentation.

Will I lose my residence permit if I get divorced?

Not necessarily. If the relationship ends, your basis for residence may be affected, but exceptions may apply, including in cases involving violence, strong attachment to Denmark or other special circumstances. This requires a specific assessment, which we can assist with.

Can I obtain permanent residence after family reunification?

Yes. This requires that you meet a number of conditions over time, including requirements concerning length of residence, employment, self-support and passed tests. The requirements depend on your specific situation, and we assist with clarifying whether you meet the conditions.

Can I obtain family reunification with my child in Denmark?

Yes. Children under the age of 15 — and in special cases children between 15 and 18 — may be granted a residence permit to live with a parent in Denmark if the conditions are met. This includes, among other things, correct documentation of custody, contact and attachment.

Can I obtain family reunification with my parents or siblings?

Only in special cases and following a specific assessment of the case. This may, among other things, be relevant in cases involving unaccompanied minors or where a parent applies for a residence permit on the basis of their adult or minor child in Denmark.
