Frequently Asked Questions About Appeal or Reopeni

Are you unsure about the rules or your options for appealing or requesting reopening?

Here you will find answers to the most common questions.

What is the difference between an appeal and a request for reopening?

An appeal is submitted to the Immigration Appeals Board if you disagree with the decision. A request for reopening is submitted to the same authority if new information has emerged that could have affected the outcome of the decision.

What is the deadline for requesting reopening?

As a general rule, there is no fixed deadline for requesting reopening. However, the request should not be submitted too late, as excessive delay may be considered prejudicial passivity.

Do I automatically have the right to stay in Denmark while an appeal is pending?

No. In many cases, this requires that an application for procedural stay is submitted in due time, and it will only be granted if the Immigration Appeals Board finds that special circumstances exist.

Can I appeal after the appeal deadline has expired?

As a general rule, no. An appeal submitted after the deadline will normally be rejected. In exceptional cases, a minor delay may be accepted if documented special circumstances exist.

Can additional information or documentation be submitted after the appeal has been filed?

Yes. Supplementary information may be submitted during the appeal proceedings, but it should be provided as soon as possible and briefly explained.

Is it always better to appeal rather than submit a new application?

No. Whether it is more appropriate to appeal or submit a new application depends on the reason for the refusal and your individual circumstances.

Can I appeal a refusal of an appeal?

No. Decisions made by the Immigration Appeals Board are final and cannot be appealed further. However, you may bring the case before the courts or request reopening if new or material information exists.
